Staunton, Dec: 26. '30.
Dr. Sir,

    I suggested to Genl. Baldwin a day or two back, that your deposition had better be taken in the Case of Oldham vs University -- as all the facts were Known to yourself -- and as I Considered you A competent witness in the cause, He agreed with me, & we concluded to write to you to that effect -- I now do so -- & advise, that you forthwith give Oldham notice for that purpose -- I would also advise that it be taken here -- as the bill, answer & all the documents of the Case are here -- & as, in all probability, it may be necessary, in your examination,to have reference to those papers -- your testimony may also be important as to the recent measurement & proceedings of the late commissioners -- three or 4 days notice will be enough -- and you had better select as early a day as practicable --
